    Decision:

    Our decision is as follows:

     

    To refuse the Application to vary the alcohol a premises licence to cover the outside area.

    To refuse the Application to vary the alcohol a premises licence to cover the outside area

     

    Our reasons for reaching the decision are as follows:

    1. Granting the license would give the Applicants the liberty to play live music and amplified music in accordance with the Live Music Act 2012 and this would not promote the licensing objective of preventing public nuisance in relation to Noise pollution to the surrounding properties.
    2. The sale of alcohol outside is likely to increase the amount of people outside and noise to the detriment of the residential neighbours.
    3. We are not satisfied that there would be sufficient preventative measures in place to control noise pollution attributable to public nuisance in the outside space.

    4.  We are not satisfied that the Applicants would be able to monitor appropriately and distinguish between members and non-members using the outside space

    We did not consider the following matters to be relevant::

    1. Car parking issues
    2. Anti-social behaviour and criminal disorder

     

    We found the following facts::

    1.  The location of the Club is in a dense residential area.

    2.  The Applicants have used the car park previously to sell alcohol and play live music and  structures were observed such as the bar and the awning.

    3.  The Club has approximately 800 members.

    4.  The Club currently has facilities inside to hold events inside with conditions to keep their windows closed. Albeit this is not enforceable between 8am-11pm.

    5.  The Club currently have a premises licence and not a club premises licence.

    6.  Alcohol can be purchased inside the premises and consumed anywhere.

    7.  The Applicants are able to apply a Temporary Events Notice.
