    Decision status: Recommendations Approved

    Is Key decision?: No

Is subject to call in?: No

    Decision:

The application be granted with immediate effect to extend the licensable area for the consumption of alcohol to include the upstairs area of the premises, as defined by the plan found in Annex B of the agenda report at page 23 of 36. The consumption of alcohol in this area is permitted between the hours of 10am until 22.30 hours Tuesday to Saturday and is permitted between the hours of 10am until 22:00 hours on Sunday.

    Our decision is as follows:-:

The application be granted with immediate effect to extend the licensable area for the consumption of alcohol to include the upstairs area of the premises, as defined by the plan found in Annex B of the agenda report at page 23 of 36. The consumption of alcohol in this area is permitted between the hours of 10am until 22.30 hours Tuesday to Saturday and is permitted between the hours of 10am until 22:00 hours on Sunday.

Our reasons for reaching the decision are as follows:

    1. Little Piggy has held a premise licence since the 10th July 2024. We have not been made aware of any complaints being made to the authority or the police relating to the premises since the licence was granted. We note particularly that no issues have been raised about anti-social behaviour, noise nuisance and, specifically, alcohol-related disorder.

    1. We have considered carefully the objection dated 17th May 2025. The objection states that

‘’occasionally we endure loud anti-social behaviour from the recently opened upstairs seating area’’

We find this to be a generic statement in that it does not specify the type of anti-social behaviour, the dates on or the times at which the behaviour is said to have occurred, or the frequency of such behaviour. If such behaviour was occurring, whether occasionally or regularly, and to the extent it was interfering with the peaceful enjoyment of domestic properties, we would have expected complaints to have been made either by the objector, or the community more generally. This is especially so given the location of the premises.

The objector does refer to one specific incident which is said to have occurred on the 3rd May 2025. This incident does not appear to have been reported to the authority as an issue at the time of its occurrence, and has only been raised after the instant application was made.

If this incident did indeed occur, we are not satisfied that it provides sufficient justification for refusing the instant application.

In conclusion, and for the above reasons, we are satisfied that the four licensing objectives are neither undermined nor compromised in granting the application to vary the current licence.

We did not consider the following matters to be relevant::

    N/A

    We found the following facts::

Little Piggy has held a licence since July 2024.

We have not been made aware of any complaints or concerns received by the local authority or police force about the premises. Specifically, there have been no concerns raised about alcohol-induced anti-social behaviour such as noise or violence associated with the premises.

We heard representations from the following persons:

    The Applicant – C McLaughlin

    Licensing Officer - William Dell’Orefice

We also considered the objection from a resident who lives next door to the property.
