Further to Minute No. 38 of the meeting held on 29th September 2010, the Executive Councillor for Resources and Policy, Councillor K J Churchill presented a report by the Head of Democratic and Central Services (a copy of which is appended in the Minute Book) regarding proposals for a change of executive to an Executive Leader and Cabinet in accordance with the Local Government and Public Involvement in Health Act 2007.

Members were reminded that they had previously approved the proposals and that these had subsequently been advertised and placed on deposit as required under the Act.  Councillor Churchill further explained that the change would come into effect three days after the elections in May 2011 and that amendments to the Council Procedure Rules would be required which would stand adjourned without discussion under the Rules until the next ordinary meeting of the Council.

Having been assured that the necessary consultation and formulation of proposals had been undertaken in accordance with the Act, the Council

RESOLVED

  (a)  that the form of the Council's Executive be changed with effect from 8th May 2011 to an Executive Leader and Cabinet in accordance with Section 11 (2A) of the Local Government Act 2000; and

  (b)  that the changes to the Constitution listed in the Appendix to the report now submitted be approved with the exception of those changes to the Council Procedure Rules which stand adjourned without discussion to the next meeting of the Council on 15th December 2010. 

  The meeting concluded at 7.06pm.

To consider a report by the Head of Democratic and Central Services on the introduction of an Executive Leader and Cabinet arrangement and the consequential changes to the constitution – TO FOLLOW.

Recommend to Council to change its form of Executive to an Executive Leader and Cabinet model, with effect from 8^th May 2011 and approve changes to the Constitution listed in the Appendix to the report, with the exception of the changes to the Council Procedure Rules which should stand adjourned without discussion, after being moved and seconded, to the next meeting of the Council to be held on 15^th December 2010.

Pursuant to Minute No. 10/38, the Cabinet considered a report by the Head of Democratic and Central Services (a copy of which is appended in the Minute Book) outlining the implications for the Council upon its decision to change its executive arrangements to an Executive Leader and Cabinet model.

In noting that the change would come into effect three days after the day of elections in May 2011 and having drawn the Cabinet’s attention to a series of consequential changes to be made to the Council’s Constitution, the Cabinet

RESOLVED

  that the Council be RECOMMENDED to

(a)  change its form of executive with effect from 8^th May 2011 to an Executive Leader and Cabinet in accordance with Section 11(2A)  of the Local Government Act 2000; and

(b)  approve the changes to the Constitution listed in the Appendix to the report now submitted with the exception of the changes to the Council Procedure Rules which should stand adjourned without discussion, after being moved and seconded, to the next meeting of the Council to be held on 15^th December 2010.
