    Councillor J W Davies, Chairman of the Licensing Committee to present a report by the Head of Legal and Democratic Services proposing the adoption by the Council of the Statement of Licensing Principles under the Gambling Act 2005.

    Minutes:

    Further to Minute No. 45 (f) and by reference to a report by the Head of Legal and Democratic Services (a copy of which is appended in the Minute Book), Councillor J W Davies, Chairman of the Licensing Committee reminded Members that the Council had been consulting the public, various public authorities and those involved in the gambling industry on a proposed new Statement of Principles under the Gambling Act 2005 due to come into effect on 31st January 2013.

     

    Members noted that the current statement would expire on 30th January 2013 and that replacement principles had been prepared in accordance with a template recommended by both the Local Government Association and Gambling Commission.  Four replies had been received in response to the Consultation exercise and had resulted in one change to the text of the Statement in relation to vulnerable persons.

     

    Having undertaken to respond, in writing, to a question received from Councillor S Greenall regarding the car parking revenue lost from accommodating travelling fun fairs, Councillor Davies moved and it was duly seconded and

     

    RESOLVED

     

      that the Statement of Principles under the Gambling Act 2005, as appended to the report now submitted, be approved to come into effect on 31st January 2013 for a period of three years duration.

    Decision:

    Recommended to full Council that the Statement of Principles under Section 349 of the Gambling Act 2005 be approved with effect from 31st January 2013 for a period of three years

    Further to Minute No. 06/117, consideration was given to a report by the Head of Legal and Democratic Services (a copy of which is appended in the Minute Book) to which was attached a revised Statement of Principles under the provisions of the Gambling Act 2005.  A report had been considered also by the Licensing Committee whose comments were relayed to the Council.

     

    Having noted that the updated statement had been the subject of a consultation exercise with interested bodies, the Cabinet

     

    RESOLVED

     

      that full Council be recommended to approve the Statement of Principles under Section 349 of the Gambling Act 2005, appended to the report now submitted, with effect from 31st January 2013 for a period of three years.

    Minutes:

    Consideration was given to a report by the Head of Legal and Democratic Services (a copy of which is appended in the Minute Book) to which was attached a revised draft Statement of Principles under the Gambling Act 2005. 

     

    The draft Statement had been approved for public consultation by the Licensing Committee at its meeting on 20th June 2012 in accordance with the Act which required the Statement to be reviewed every three years.

     

    Having noted that the Statement had now been amended to take into account both Gambling Commission guidance and, where appropriate, consultation responses, it was

     

    RESOLVED

     

    that the Council be recommended to approve the Statement of Principles under Section 349 of the Gambling Act 2005 as set out in Appendix 1 of the report now submitted, for a period of three years commencing on 31st January 2013.

    Deferred the report of the Head of Legal and Estates and the attached revised Gambling Act 2005 - Statement of Principles to enable the deliberations of the Licensing Committee to be considered at that time.

    Given that the report of the Head of Legal and Estates and the attached revised Gambling Act 2005 - Statement of Principles would be considered by the Licensing Committee at their meeting on 23rd October, the Cabinet

     

    RESOLVED

     

      that the report of the Head of Legal and Democratic Services and the attached Statement of Principles – Gambling Act, be deferred to the next meeting of the Cabinet to enable the deliberations of the Licensing Committee to be considered at that time.
